Apiros (the society) is committed to protect your privacy, as well as to give an appropriate use to your personal information; it is for this reason that we invite you to read the information below:

What is personal data?

Personal data is any kind of information that would enable a person to identify another.

What does “data manipulation” mean?

Data manipulation is any kind of operation performed involving personal data, such as gathering, storing, use, transmission or deletion of personal information.

Do personal data manipulation policies exist?

Yes, policies about the use of personal data exist and are available at: www.apiros.com.co/en Any modification to such policy or to this notice will be informed in the moment it takes place; such modifications will be notified through the communication channels established between the company and its users.

What is the purpose of personal data manipulation?

The company will only request details needed to: 1) Carry out its operations of social purpose and in accordance with the contractual relationship established with its user/client; 2) Manage your products or services so as to commercialise them through the company; 3) structure commercial offers and to forward to you commercial information about products or services through the communication channels established between the company and its users; 4) adopt measures to prevent criminal activities. The society has adopted adequate security measures in order to protect and ensure the appropriate manipulation and confidentiality of personal data.

Who is authorised to have access and manipulate your personal data?

Authorisation to manage and to manipulate personal data is granted to only those individuals who represent the society, that is, personnel hired by the company to this effect or those to whom the society has transferred the rights, obligations, its contractual obligations, or any other legal obligations in relation with the products and services of which it represents. Likewise, this authorisation covers other societies in which the society has commercial involvement, as well as third parties with whom the society, or the other societies already mentioned, have established commercial partnerships through which .products or services of your interest may be offered to you.

How do we obtain your personal data?

The society obtains your personal data through your willingness to voluntarily submit such details into our database, through third parties authorised either by you or by law to share your personal data with us, or through the public availability of your data, for which case your authorisation is not required previous to the manipulation of your personal data.
How is underages’ personal data managed?

The society takes very seriously the prioritization of minors’ privacy and therefore it makes it prevail. In addition to this, when minors’ rights are being executed by third parties, the society, before proceeding with any actions requested by this particular user, verifies the authenticity of the third party and its legal authorisation to access a minor’s personal data.

What is the data manipulation policy in terms of sensitive data?

Sensitive personal data is defined as data that contains intimate personal information and that due to careless use could be used to discriminate the user. If the society requires to manipulate this kind of data, it will inform you about the use of sensitive data, as well as the need it has to gather this information. The society will not condition the access of sensitive data to your products or services, unless such data should be essential for the existence and/or adequate maintenance of your products or services, according to the responsibilities and/or needs of the user. Likewise, sensible data will be managed according to the security measures stipulated by the law.

Why is personal data maintenance required?

The society requires to adequately manage your personal data in order to constantly review the relationship established with the user, as well as to perform activities planned as part of the data manipulation authorisation requested by the society for this purpose.

Is it possible to transfer personal data overseas?

Yes. It is possible that your personal data may be transferred and managed overseas in order to comply with the society’s duties already established. With this in mind, the society has adopted the corresponding security measures to ensure personal data protection.
What are the personal data owner’s rights?

You are entitled to:
a. The right to know: You can request the society, at any time and free of charge, to inform you what kind of personal data it holds from you and what uses it has given to them
b. The right to update: You can request the society, at any time and free of charge, to update your personal data. To complete this process you must ensure the additional information you provide the society with, including its supporting documents and/or files for this purpose, is completed in an accurate and quick manner.
c. The right to rectify: IF you consider that the data you have provided the society with, is in any manner inaccurate or incomplete, you can request the society, at any time and free of charge, to rectify such data. For this purpose you must: identify yourself, explain the data inaccuracies or inconsistencies and provide the adequate information in an accurate
and quick manner.
d. The right to delete: You can request the society, at any time and free of charge, to delete any data that you consider relevant. For this purpose you must: identify yourself, explain the data inaccuracies or inconsistencies and provide the adequate information in an accurate and quick manner.
e. The right to revoke the authorisation previously given: You can revoke the authorisation previously given to the society, as long as this request does not incur in a legal or contractual violation.
f. The right to request authorisation proof: You can request the society to support the existence of an authorisation given the need of this as per according legal requirements.
g. The right to put a complaint before the Superintencia de Industria y Comercio: You can complaint before the Superintendencia de Industria y Comercio, if you feel/consider that an irregularity has taken place with regards to personal data security normativity.

How can the personal data owner uphold his/her rights?

The society has designated its commercial office as the contact point where you can uphold your rights, suggest, request, or complaint . Any of the previous can be made through the established communication channels during the following opening hours:

What are the personal data owner’s obligations?

To provide the society with his/her personal data in an accurate, quick and complete manner; to claim his/her rights in an appropriate manner; to comply with the security measures put in place and/or as recommended by the society to ensure confidentiality; to periodically enquire about information on the society’s privacy policy, and to update his/her personal data at least once a year.

According to the current normativity on personal data protection (Law 1581 of 2012 and Decree 1377 of 2013), the data entered by you will remain incorporated in our database Consultas, and will be exclusively with the intention to receive and answer enquiries and send notifications. Personal details will be treated under the data protection required, taking all safety measures to avoid its alteration, loss, wrong handling or non authorised access by third parties.

Consultation and data claiming procedure

Data enquiries and complains

  1. Enquiries

Personal data owner or his/her successor

  • Submit your enquiry or request though the communication channels enabled by the
    society.

Society

  • Receives and responds to the personal data owner or successor, within ten workdays (10)
    from the day the enquiry or request was submitted.

Given the society cannot respond to your enquiry/request within the time stipulated, it will inform you about the reasons causing the delay; it subsequently will fix a new date to respond to your enquiry/request. This new term cannot, in any case, be longer than five
workdays (5).

  1. Complaints

The personal data owner or his/her successor who feels/considers that his/her personal information held in any of the Society’s database should be corrected, updated or deleted, or when an alleged violation to any of the responsibilities established by law 1581 of 2012 (on the protection of personal data) and decree 1377 of 2013, could put a complaint before the society (as responsible for the management or manipulation of the data),
which should be processed as follows:

  • Put a complaint through a formal request addressed to Apiros S.A.S. through the communication channels available for this purpose (*), and which should contain: (i) personal details; (ii) complaint description; (iii) notification address; and (iv) documents to
    be filed as part of the complaint.

Society

  • Receives and reviews supporting documentation, if required.
  • It immediately uploads the complaints the complaint onto the system, registering reception date, complainant’s name, and complaint’s description.
  • If the society identifies that the complaint has been wrongly filed, it will require the  complainant to rectify the mistake made within the next five workdays (5).

If two months (2) have passed since the filing date without the the complainant submitting the information required by the society, it will be understood that the complainant has voluntarily given up the complaint.

  • If the society finds out that it is not a competent authority to deal with the complaint, it will pass on the complaint to a competent authority within two workdays (2) and will inform the complainant about the situation.
  • Analyses, solves (if it is the case) and answers the personal data owner or his/her successor within fifteen works days (15) from the next workday in which the complaint was filed.

If the society cannot process the complaint within the stipulated times, it will inform the complainant the reasons for the delay and will give the complainant a date in which his complaint will be handled, which in any case can exceed eight workdays (8) after the first term had expired.

You can appeal to the Superintendencia de Industria y Comercio once the Society had exceed the stipulated times to answer to your complaint.
